Senior citizen group seeks recovery of Medicare expenses from U.S. cigarette makers

A U.S. lobbyist group, the United Seniors Association, filed a lawsuit in U.S. District Court in Boston to recover Medicare expenses related to tobacco smoking. The suit says there is a link between nicotine addiction and smoking-related diseases.

The first of its kind lawsuit seeks to recover as much as $60 billion in estimated Medicare expenses outlaid for treatment of lung cancer and emphysema patients.

The Medicare Secondary Payer Statute (MSP) allows someone to sue on behalf of Medicare. The medical expenses that another party was legally obligated to cover, in this case the tobacco companies if they are found liable in court, would be split between parties to the suit and Medicare. The MSP statute was entered in part because the government does not have the resources to prosecute every case under Medicare law.

Charles Jarvis, the CEO of the group said, “Our motivation is one of taxpayer protection.” He added, “Considering how badly the taxpayers have been injured financially, we believe the responsible parties — the tobacco companies — should be reimbursing the taxpayer to the greatest amount possible under the law.”

Currently, U.S. employees are taxed by Medicare at 1.45% of their earnings. This payroll tax amount is matched by their employer when paid to the IRS.

The lawsuit names Philip Morris USA, Lorillard Tobacco, the Liggett Group, and R.J. Reynolds Tobacco and two of its subsidiaries as defendants. The United Seniors Association is asking for twice the amount paid by Medicare to treat smoking related illnesses since 1999.

US Secretary Rice responds to European enquiries on alleged CIA prisons

The United States Secretary of State Condoleezza Rice has begun to address concerns raised by the EU, the Council of Europe, and several member countries about the CIA’s detention practices upon her arrival in Germany for a European tour that began Tuesday.

“As a matter of US policy, the United States’ obligations under the U.N. Convention Against Torture, which prohibits, of course, cruel and inhumane and degrading treatment, those obligations extend to US personnel wherever they are, whether they are in the United States or outside the United States,” said Rice, speaking from the Ukrainian capital of Kiev on Wednesday.

Media reports and Human Rights groups have alleged that the CIA transported renditioned prisoners through European countries, which could violate European laws and the sovereignty of countries involved. Secretary Rice claimed that the United States has respected the sovereignty of other countries, and that it has not transported detainees from one country to another for the purpose of interrogation using torture, and has not transported anyone to a country when we believe he will be tortured.

“We consider the captured members of Al-Qaeda and its affiliates to be unlawful combatants who may be held, in accordance with the law of war, to keep them from killing innocents. We must treat them in accordance with our laws, which reflect the values of the American people. We must question them to gather potentially significant, life-saving, intelligence. We must bring terrorists to justice wherever possible,” Rice told reporters before she left from Andrews Air Force base on Monday.

Rice said that European nations should realize that interrogations of terrorist suspects have produced information that has saved European lives. However, Secretary Rice provided no specific cases.

“Secretary Rice made extra-legal rendition sound like just another form of extradition. In fact, it’s a form of kidnapping and ‘disappearing’ someone entirely outside the law,” said Tom Malinowski, a Human Rights Watch official in Washington.

The CIA practice known as “extraordinary rendition” is used to interrogate terrorist suspects outside the U.S., where they are not subject to American legal protection.

“Kidnapping a foreign national for the purpose of detaining and interrogating him outside the law is contrary to American values,” said Anthony D. Romero, executive director of the American Civil Liberties Union (ACLU) on the Khalid El-Masri case. “Our government has acted as if it is above the law. We go to court today to reaffirm that the rule of law is central to our identity as a nation.”

The ACLU feels the government has to be held to account over “extraordinary rendition”.

Mario Lopez favored to win Dancing with the Stars

Mario López is favored to win the third season of American television series Dancing with the Stars, with 3:1 odds of winning, but close on his heels is actress Vivica Fox, with four-to-one odds. López is perhaps best known for his role on Saved by the Bell, and currently stars on soap opera The Bold and the Beautiful. Gambling site BetBet released odds on its website recently.

Monique Coleman (High School Musical), Joey Lawrence (Blossom), and Harry Hamlin (Clash of the Titans), each with six-to-one odds. Hamlin’s wife, Lisa Rinna, was a contestant in the second season of the series. Singers Willa Ford and Sara Evans each rank 8:1.

It is unknown how the firm decided the competitor’s odds; none of this year’s dancing has been previewed publicly, let alone for the press.

Dancing with the Stars enters its third season on September 12, at 8pm, with a two-hour season premiere. The series was a surprise hit for ABC, who added the program as a summer filler, with no large hopes for its success. Based on the British series Strictly Come Dancing, the series has been produced in 20 countries.

Celebrating her seventieth birthday in early July, expected to set a record for most appearances at her eleventh Games, Kosmala is likely to be the oldest athlete in attendance.

Her first Games were the 1972 Heidelberg Games competing in swimming and athletics events and winning a bronze medal in the mixed medley relay. Kosmala then switched to shooting and between 1976–1988 won nine gold and three silver medals.

At the 2008 Beijing Games she narrowly missed a medal, coming fourth in the Women’s Air Rifle Standing SH1. In 2011 at the IPC Shooting World Cup, her level of competitiveness was highlighted by finishing fifth in the final of the Women’s 10m Air Rifle Standing SH1. Kosmala is looking forward to the London Games saying: “It’s very exciting. I’m looking forward to it. In over ten Paralympic Games, my greatest success was at Stoke Mandeville in 1984, so I’m looking forward to competing in London again for Australia”.

Kosmala loves beating athletes half her age: “Competition brings out the best in you. I’m old enough to be their grandmother for a lot of the players, but they really are lovely”. Kosmala’s training involves physical training, three shooting sessions per week and mental relaxation training. The London Games will be her swansong but she will still keep shooting. She puts her longevity down to steadiness and a keen eye. Ashley Adams is to join her on the shooting team, attending his fourth Games, as will newcomers Luke Cain, Jason Maroney and Bradley Mark.

Russell Short, a vision-impaired thrower and the Australian Institute of Sport’s first athlete with a disability scholarship, in 1988, has been selected for his seventh Games. Another athlete likely to attend his seventh Games is Kieran Modra, a vision impaired cyclist. Selections for the cycling team are yet to be confirmed.

Two athletes who extended their Paralympic careers by changing sports have been selected; Greg Smith, who previously took part in track and field events, will be competing in wheelchair rugby. This is to be his fifth Games. Liesl Tesch, a former Australian wheelchair basketball player and captain, will be competing in sailing for her sixth Games.

Five convicted in abortion case in Portugal

A doctor, his assistant and three women who were found to have undergone abortion were convicted of violating abortion laws in Portugal.

The three women were found to have undergone abortion in violation of Portuguese law. Abortion is illegal in Portugal except where a pregnancy is caused by rape or when the health of the mother is in danger due to the pregnancy. Further, abortion cannot be performed after the first trimester (the end of 12th week).

Twelve other defendants, mostly women and their partners, were found not guilty. The doctor was sentenced to 3 years and 8 months in prison. His assistant was deemed an accomplice and sentenced to 1 year and 4 months in prison. The three women were given 6 month suspended sentences.

All the defendants had earlier been acquitted of the charges in 2004 for lack of evidences. That decision was declared void by a superior court on appeal. The court decided that the medical examinations conducted on the women, which were performed without a court order or the presence of a state witness, were legal.

The Internet has already brought great things to the world, but has also brought spam, phishing, scamming, etc. We all have seen them across the Internet. They promise money, weight loss, or other things a person may strive for, but they usually amount to only a lighter pocket. Online advertising has become something that the increasingly Internet-reliant society has become used to, as well as more aware of. As this is true, online ads have become more intricate and deceptive in recent years.

However, a certain type of advertisement has arisen recently, and has become more deceptive than any other Internet ad, and has tricked many users into credit card charges. These sites claim to be news websites that preach a “miracle product”, and they offer a free trial, and then charge the user’s credit card a large amount of money without informing them after the trial ends. These sites appear to be operating under one venture and have caught ad pages of high-traffic websites by storm. In this report, Wikinews’ Tjc6 investigates news advertisement sites.

These Internet ads work in different ways:

Hypothetically speaking, a reader is browsing the web, and then happens to come across something that they believe is too good to be true. A link on one of these high-traffic pages promises white teeth, weight loss, or huge profits from working at home part-time. Out of curiosity, they click on the link.

This is the way that people are attracted to these fake news sites on the internet. The domain owners draw in customers by purchasing advertising on some of the World Wide Web’s most visited pages. Curious users click and are led to what they believe is a news article. From anti-aging to shedding weight, these “articles” from non-existant newspapers and television stations depict a skeptical news reporter trying a product because they were instructed to by a superior.

As the user reads on, they find that the “reporter” miraculously achieves significant weight loss, teeth whitening, or other general health and beauty improvement. The reporter states that the reader can get the same results as they did by using a “free trial” of the product.

Next, the user looks to the bottom of the page, where there seems to be a set of user comments, all of them praising the product or products that are advertised — this is where we first see something suspicious. Across several of these false articles, the comments appear to show the exact same text, sometimes with even the same usernames as other sites.

There is obviously some kind of correlation. Although this appears to be true, most users who purchase these products do not look at multiple versions of these similar pages of what appears to be a fast-growing network of interconnected fake news sites.

Once customers have convinced themselves into buying the product, they are led to a product (or products) website which promises a free trial for a very low price. What they do not know about this, however, is that they are giving their credit card data to a company that will charge it automatically after the trial ends. In about 14 days, the user receives a charge on their credit card for an excessive amount of money, usually from about $80 to $100 (USD). All attempts to contact these companies and cancel their shipments usually prove to be futile.

What these sites have is a large amount of legal copy located at the bottom of each site, stating their right to charge the user. This site, a fake news article claiming to offer teeth-whitening benefits, has several paragraphs of fine print, including this: “…Upon signing up for the 10 day trial membership you will be charged up to $4.97 depending on various shipping and initial offer promotions at that time but not more than $4.97 upon signing. If not cancelled, you will be charged $89.97 upon completion of the 10 day trial period. Monthly thereafter or 30 days from the original order date, the charge will reoccur monthly at a total of $89.97 until cancelled…,” the site says.

Practices like this have alerted the Better Business Bureau, an American organization that studies and reports on the reliability and practices of US businesses. In a press release, a spokesman from the BBB spoke out against sites like this. “Many businesses across the country are using the same selling model for their products: They lure customers in with claimed celebrity endorsements and free trial offers, and then lock them in by making it extremely difficult to cancel the automatic delivery of more products every month…,” said the report that denounced the websites.

When a user looks at several of these sites, they notice that all of them have the same exact structure. Because of this, Wikinews decided to look into where some of the domains were owned, and if they were all in fact part of one company.

However, the results that Wikinews found were ones that were not expected. Out of the three random websites that were found in Internet ads, all using similar designs and methods to attract the customers, came from three different locations in three countries and two separate continents. The first came from Scottsdale, in the United States, while the next two came from Vancouver and Hamburg. There is no location correlation, but surely, there has to be something that connected these sites together. We had to look even further to try to find a connection.

There is some correlation within the product’s contact information. A large amount of the teeth-whitening products analyzed actually shared the same phone number, which lead to a distribution center located in St. Petersburg, Florida, and several other similar distribution centers located across the Southern United States. But, that explains only one of the categories of products that these websites cover, teeth whitening.

What about the other products? The other products such as weight loss and work-at-home kits all trace back to similar distribution centers in similar places. So, what do we make of all of this?

There is obviously some company that promotes these products through the fake news advertisements, but that company is nowhere to be found on the websites. All contact information is given on the product pages, and websites are copyrighted under the name of the domain, not a company. Whatever company has been the setup for these pages has been very good at hiding themselves from the Internet, as there is no information across the web about that mysterious large advertiser.

As a result of customers buying the products and having unauthorized charges on their credit cards, a large volume of complaints are currently present on awareness sites, complaint sites, and even the Better Business Bureau. Several customers point out that they were not informed of the steep charges and the company made it extremely difficult to cancel their subscription, usually resulting in the loss of several hundred dollars.

  • The trial offer was to pay for $3.95 for the cost of the shipping for one bottle. I noticed shortly after placing the order I had a charge on my credit card for $149.95. Unknown to myself the company charges for a membership if you don’t cancel within 14 days, I cancelled within 18 days…When I called the customer service number they told me the decision has been made and my refund request was denied. When I questioned the person on the other line about what I was getting for my $149.95 she told me I was not getting anything because I cancelled the membership.

  • This is a “free sample” scam: Pay only postage and handling and get a free sample of a tooth whitening system, they say. I looked for the “catch,” something that would indicate that there’d be hidden or recurring charges, but didn’t see anything, and ordered. Sure enough, a couple of weeks later, I see a charge for $88.97 on my bank statement…When I called, the guy answering the phone had obviously answered the same angry question many, many times: “Why has your company charged $88.97 to my card?” “Because you didn’t cancel your subscription in time,” he said tiredly.

One notable lawsuit has occurred as a result of these articles. Some of the articles about work at home kits specifically advertise things like “work for Google”, or “job openings at Google”. However, Google asserts these claims as false and has taken the case to court, as it is a copyright violation. “Thousands of people have been tricked into sending payment information and being charged hidden fees by questionable operations,” said Google in a statement.

The BBB has received over 3,000 complaints about products such as the ones that Google took offense to. The lawsuit has yet to begin in court, and no date has been set.

Hare Krishna village demolished in Kazakhstan, religious persecution alleged

An ongoing struggle in Kazakhstan between the authorities and a local Hindu village has turned serious. Forum 18 has been documenting the alleged human rights abuse regarding the Hare Krishna village for some time, but as of 21st November events took a drastic turn.

The following was seen and written by Ninel Fokina, president of the Almaty Helsinki Committee, and Andrei Grishin, official member of the International Bureau of Human Rights and Law Observance:

On November 21, 2006 at 1 pm the information was received that according to the court decision to evict the members of the religion organization International Society for Krishna Consciousness from the occupied land near Sri Vrindavan Dham farm, and the demolition of 13 country houses will beginimmediately.

Heavy equipment was brought to the suburban community: trucks, demolition machines, three busses with riot policemen, a bus withdemolition squad and the local authorities including the Hakim. Electricity was disconnected in the morning of the same day.

There were only women and children in the village. All men went to work in town.

The president of the Almaty Helsinki Committee Ninel Fokina tried to contact different officials in Astana (the capital): B.Baikadamov, the envoy of human rights, B. Muhamedjanov, the minister forinternal affairs I. Bakhtibayev, the assistant General Prosecutor; R.Aliev, the deputy minister for foreign affairs.

She had a conversation with B. Baikadamov, the only person she could reach at that time, who promised to communicate to theCommittee of Religious Affairs at the Ministry of Justice, the Supreme Court, and the Court Administration Committee which includes the department of court decision execution.

At 3 pm representatives of human rights organizations: Ninel Fokina, Andrei Grishin, and Maxim Varfolomeev, press-secretary of theSociety for Krishna Consciousness, plus, a journalist and representativeof Astana TV channel left for the village which is located 40 km fromAlmaty.

All the roads to village were closed and patrolled by police. They would not let anyone go through. The human rights representatives and the journalist took detour through the fields. It was snowing, but they were able to reach the border of the village because of the four-wheel-drive jeep they were traveling in. But even that road was closed by patrol.

The jeep was not allowed to drive into the village. The patrol explained it was instruction of authorities. When Grishin and the jeep driver tried to pass by walk they were stopped and threatened to beput in handcuffs. And the patrol promised to send for additional force.

Lieutenant colonel, who came with another patrol car, explained that they are not allowed to the village for their own safety. He said that at that time the electric line was being dismounted in the area.

The driver of the jeep had his wife and two months old daughter in thevillage. He was begging to let him go through, but his request was denied. He was told that safety is guaranteed to his family.This group could still enter the village. They approached it from the other detour road, and leaving the car on the sidewalk, one by one theyentered the village.

As they approached the village they met two small groups of young people who were not drunk but unnaturally exited.They held hammers, big dumb-bells, metal crow-bars and sticks. Two of them politely greeted the group, and one said gaily, “Your houses are finished.

Four big busses with toned windows and two cars of ambulance were parked at the entrance of the village in the grove. 30-40 policemen stood by the houses, and 20-30 people in civil clothes includingthe leaders of the district with the Hakim, the head of local executiveauthority stood on the street, watching the demolition.

It was snowing. Residents’ household stuff such as mattresses, blankets,utensils cookware, and furniture were laying outside on the lawns by their houses. People in construction outfits (labor people) got inside the houses and started crushing windows and doors, destroyingwalls. The bulldozer was demolishing the buildings and the big stone fencing with cast iron openwork lattice which separated the houses from the driving area.

A small group of inhabitants (20-30 people, mostly women) did not offerphysical resistance. One of the women felt dizzy, fell down and was picked up by the ambulance. Police was bringing down thosefew (basically women) who tried to interfere with the destruction of their property. Two men tried to prevent the entrance of destroyers into a house, but were brought down by 15 policemen who twisted their hands and took them away to the police car.

During all these events none of the representatives from the Office ofPublic Prosecutor were present at the place of the event, even though both Krishna people and legal service people demanded meeting with representatives of the Office of Public Prosecutor who are obligated to be present during this type of actions.
